This category provides for people immigrating to the UK to perform temporary low skilled work and replaces the Seasonal Agricultural Workers Scheme (SAWS) and the Sector Based Scheme (SBS). Under this Tier migrants will be granted leave to enter the UK from countries where an effective returns arrangement with the UK is in place (ie a country to which a person can be returned without difficulty).The Tier 3 visa replaces the Work Permit Visa and application is made by the employer who must attempt to source labour in the domestic market before recruiting from outside the EU. The intention of the Tier 3 visa is to provide for the variable need for low skilled workers throughout the year and will be used in circumstances where the Skills Advisory Body (SAB), identifies a shortage area not able to be filled from the domestic labour force.


Entry to the UK under a Tier 3 visa will require a Certificate of Sponsorship as part of the application. The Sponsor will be the operator of a particular low skilled worker scheme and the Certificate is confirmation that the applicants immigrating to the UK will be bound by the terms of this route. Applications at Tier 3 level do not constitute a route to settlement and do not provide an opportunity to apply for permanent residence in the UK. A tier 3 visa will be granted for a maximum of 12 months at the expiry of which the visa holder will be required to return home. The visa holder cannot switch to another type of visa.
